ACA Terms and Conditions

In making this application I agree, state and acknowledge that:

This agreement, together with the policies and procedures set out in the ACA Membership Agreement set out my obligations and those of Australian Counselling Association Inc. (“ACA”).

I agree to and are bound by the following terms and conditions, whether I have read the terms and conditions or not. These terms and conditions are subject to change.

INFORMATION

I declare that I am 18 years of age or older.

I warrant that all information I have provided is accurate and complete, is not misleading, and that I have included all information that may impact on my application to ACA and my continuance as a member of ACA.

I acknowledge that I must inform ACA within seven (7) days of any changes to my personal details including but not limited to name, address, postal address, email address, phone numbers, or any material change that may affect my continuance as a member of ACA.

MEMBER CRITERIA

I understand that membership to ACA is subject to specific entry criteria and that I meet, and continue to meet, the criteria for the membership in which I am registered.

ONGOING RIGHTS

I understand my rights and obligations as a member and that these rights and obligations may be updated from time to time and I will remain bound by the terms including any varied terms.

ACCESS TO SERVICES

I understand that as a member I have access to various services, whilst all my member fees are up to date and that if my member fees become in arrears, access to member services will be suspended or cease, and in such circumstances ACA is under no obligation to provide services.

COPYRIGHT

I understand that all content (whether electronic or physical), including but not limited to, documents, guides, codes and certificates, which are made available or received by me during my membership are protected by copyright and I agree that I will not sell, reproduce, copy or loan any item to any other person or institution.

I acknowledge that the relationship between ACA and myself shall not constitute a relationship of partnership or joint venture or any other relationship where ACA can be held responsible in any way for any actions or words made by me (whether verbally or electronically).

SITE USAGE

I understand that access to the ACA Member Portal is for my personal use only and that I am not permitted to share login details with others under any circumstance. I understand that I alone am responsible for activities that occur under my access details.

I understand that access does not in any way imply ownership of content and that I am not permitted to copy, distribute, sell or publicly share any resources, including my login details.

REPUTATION

I will at all times respect the good name of ACA and will maintain the highest possible standards of confidentiality, ethics and behaviour in all relevant practices and will at no time take any action or utter any words which might in any way damage ACA.

ACCEPTING AGREEMENT

I acknowledge that I am accepting the terms of this agreement and the terms as set out in the ACA Membership Agreement by clicking “Accept” or “Enrol” on the online membership application form on the webpage.

The start date of this Agreement (Agreement Date) is the date on which you have accepted this Agreement in accordance the above.

By accepting this Agreement, I consent to ACA sending me electronic messages or contacting me at the phone number and email address I provided.

ADMINISTRATIVE FEES

ACA reserves the right to charge a reasonable administrative fee for each process where an electronic substitute or that process exists, such as membership applications and renewals. The quantum of any administration fee reflects the complexity of the process and may be within the band of $20 to $50.

CURRENCY AND FOREIGN EXCHANGE

I understand that my membership fees and other charges will be processed in Australian Dollars (AUD). I understand that if I live outside or Australia, charges may be subject to foreign exchange and that I may be subject to other transaction fees by my financial institution.

ORDER PROCESSING

I understand that ACA will use its best endeavours to process orders and that delivery times may vary due to staff workload, time of year and other factors and accept the following timeframes as a guideline for delivery.

  • Memberships: Allow up to 10 business days.
  • Qualification Assessment: Allow up to 10 business days.
  • Merchandise: Allow up to 10 business days for dispatch of order and another 3 working days for delivery by post.
  • Advertising: Allow up to 5 business days for processing.
  • Professional Development Endorsement: Allow up to 5 business days for processing and approving.

REFUNDS & RETURNS

Membership

Application fees for membership are non-refundable where applications are unsuccessful. Application fees cover costs actually incurred by ACA to process your application.

Annual membership fees may be refundable on a pro-rata basis, at the discretion of the Association. Requests for refunds must be made in writing. Where membership is suspended due to an adverse finding in the hearing of an ethical complaint, no refund of Annual Membership Fees is applicable.

Merchandise

If you are not happy with your merchandise purchase, please return it to the Association within 28 days with the receipt for a refund or exchange. Any delivery and packaging charges are not refundable. All returns must be sent to the postal address of ACA as per the Contact page on the ACA website. A refunds or exchange of the goods will be issued only upon receipt of goods is a saleable condition.

Professional Development Endorsement

Once approval has been issued by ACA for professional development endorsement, no refunds are applicable.

POSTAGE & HANDLING

For merchandise orders, postage and handling costs (including GST where applicable) are included in the total purchase price. Postage and handling charges cover orders dispatched to all regions of Australia. For international orders, a standard shipping charge of $44 is applicable. If you are not home at the time of delivery, Australia Post will leave a calling card for you to pick the parcel up from your local post office.

PRIVACY POLICY

Information provided to ACA is done so on a voluntary basis. ACA collects, uses and manages information in accord with the Australian Privacy Principals. ACA is committed to ensuring the security and integrity of the information it collects, uses and discloses.

Where an individual believes that ACA has breached a Privacy Principle in relation to that individual they may lodge a complaint using ACA’s grievance handling procedures.

SECURITY

ACA utilises the highest level security standard for all online transactions, being a PCI Service Provider Level 1 provider. All credit card numbers are encrypted, and no credit card information is held by ACA. TRANSACTION DISPUTES

In any instance where you believe you have been wrongfully charged, please inform ACA immediately. An ACA staff member will investigate the transaction dispute. Refunds will be applied in accord with the Refund and Return Policy. To notify ACA of a transactions dispute, please call ACA on 07 3356 4255 or email [email protected].

This Agreement is governed by and must be construed in accordance with the laws in force in Queensland, Australia. The parties submit to the exclusive jurisdiction of the courts of that State and the Commonwealth of Australia in respect of all matters arising out of or relating to this Agreement, its performance or subject matter.
